These Terms of Service govern use of the live streaming platform (the “Platform”). The Platform is offered by the operator of this platform. By using the Platform – in particular by registering a user account, transmitting a stream, or participating in the accompanying chat – the user accepts these Terms of Service.
The Platform allows registered users to transmit their own video and audio content to the Platform via RTMP and have it relayed live to other users and visitors (live relay), as well as to participate in an accompanying text chat per channel. Transmitted streams are relayed live only; there is no recording or permanent storage of the video content. To operate the Platform, preview images (thumbnails) are automatically generated from the running stream, and technical metrics (including bitrate, resolution, and viewer count) are processed. Use of the Platform is free of charge.
Users are solely responsible for all content they transmit or publish via the Platform – in particular streams, stream titles, categorization, and chat messages. The operator merely provides the technical infrastructure for transmitting and displaying this content and is a provider of a hosting service, or a mere-conduit service, within the meaning of Regulation (EU) 2022/2065 (Digital Services Act – DSA).
The operator does not review the content transmitted by users, either before or during transmission, and is not obliged to generally monitor the information it stores or transmits, or to actively seek facts or circumstances indicating illegal activity (Art. 8 DSA). Liability of the operator for third-party content provided by users arises, pursuant to Art. 4 to 6 DSA, only upon obtaining knowledge of a specific unlawful act or piece of information; upon obtaining such knowledge, the affected content is promptly blocked or removed (Art. 16 DSA).

The operator reviews incoming reports promptly and carefully and removes or blocks the content in question if the suspicion of unlawful conduct is confirmed. The affected user is informed of the decision taken, to the extent legally permissible and practicable.
In the event of a violation of these Terms of Service or of applicable law, the operator may, depending on the severity and repetition of the violation, take one or more of the following measures: issuing a warning, ending the ongoing transmission, temporarily or permanently suspending the user account, and adding the email address used in connection with the violation to a block list that prevents re-registration. The choice of measure is at the operator's reasonable discretion and must be proportionate to the severity of the respective violation.
By transmitting a stream, the user grants the operator the technical usage rights required to provide the service described in Section 2, in particular for the live relay of the stream to viewers, the automated generation of preview images, and the operation of technical embeds and overlays within the Platform. No further exploitation of the transmitted content by the operator takes place, in particular no permanent storage, resale, or use outside the operation of the Platform.
The operator is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence on the part of the operator, its legal representatives, or vicarious agents. For damages resulting from the breach of a material contractual obligation (cardinal obligation), the fulfillment of which is essential to the proper use of the Platform in the first place and on whose observance the user may regularly rely, the operator is also liable in the case of ordinary negligence; in this case, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded. Otherwise, the operator's liability for ordinary negligence is excluded.
The Platform is provided free of charge; no guarantee is given for its continuous availability or being free of errors. Maintenance work, technical faults, or interruptions of transmission are possible.
User accounts are provided free of charge and for an indefinite period. Users may stop using the Platform at any time and may request deletion of their account at any time without notice, via the contact address published on this website. The operator may likewise terminate a user account at any time with reasonable notice; the right to extraordinary termination for good cause, in particular in the event of a violation of these Terms of Service, remains unaffected (see Section 6).
The operator reserves the right to amend these Terms of Service with effect for the future, for example to adapt them to changed legal requirements or to the scope of functionality of the Platform. Users will be appropriately informed of material changes. Continued use of the Platform after the amended terms take effect constitutes acceptance of those terms.
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which a user has their habitual residence remain unaffected.
Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected; the invalid provision shall be replaced by the applicable statutory rule.
